Event Description:This seminar organised by the ASEAN IPR SME Helpdesk and local partners in Thailand will look into the issue of franchising in South East Asia.
Franchising is a business system for expanding sound businesses, based on successful concepts, know-how and brand. It is a business model replicated through the creation of a network under the same brand name.
The franchise business model is becoming more widespread in South East Asia, as investors seek to start a business that allows the franchisor to promote a successful business model or product to another geographical area, while many of the risks are borne by the franchisee. At the same time, franchising is attractive to franchisees because it authorises the franchisee to use this successful business model or product while deriving greater benefits from the business compared to that derived from a company-owned outlet. The franchise agreement itself will allow franchisees to use the IP (trade marks, so called trade dress, trade and production secrets copyrights, designs, goodwill and the like) of franchisors.
Plans must be carefully drawn up to cover all anticipated eventualities and ensure good quality control within the franchise. SMEs that are looking to franchise their business into Southeast Asia must also bear in mind that, whilst there are many successful franchises in the region, there are also many cases of franchisees ending the agreement and starting a business independently, using the knowledge that was obtained from the franchise operation. This ASEAN IPR SME Helpdesk event, in association with partners in Thailand, aims to look aspects of franchising directly related to intellectual property from a legal and business point of view, as well as look at different tax regimes in the region which may be more favourable to such a step.
